Presenters and Biography: Michael L. Buckner is the shareholder of the Michael L. Buckner Law Firm. Mr. Buckner, a licensed attorney and private investigator, advises organizations on compliance, investigation, ethics, training, and management enhancement issues. Mr. Buckner represents academic institutions before all NCAA committees, including colleges and universities in the enforcement process and secondary schools in the high school review process. Mr. Buckner, as an independent consultant for the NCAA (2006-07), conducted on-site investigative audits of non-traditional and preparatory schools in the United States and Puerto Rico. Mr. Buckner has appeared on HBO’s Real Sports with Bryant Gumbel and ESPN’s College Football Live, as well as been quoted in numerous newspapers (including the Wall Street Journal, Los Angeles Times, USA Today, Detroit Free Press, Detroit News and Lexington Herald-Leader), as a commentator on NCAA enforcement cases. Mr. Buckner is the author of two books, Athletics Investigation Handbook: A Guide for Institutions and Involved Parties During the NCAA Enforcement Process and The ABCs of Ethics: A Resource for Leaders, Managers, and Professionals. Mr. Buckner is admitted to practice before the United States Supreme Court, the United States Court of Appeals for the Eleventh Circuit, and all federal and state courts in Florida. Mr. Buckner served as a commissioner on the Broward County Charter Review Commission and Volunteer Florida, the Governor’s Commission on Volunteerism and Community Service. Mr. Buckner earned his bachelor’s degree in international relations and social sciences and communication in 1993 from the University of Southern California. He was awarded a law degree in 1996 from Florida State University, where he was a member of the Moot Court team.
Course Summary: National attention has focused on several NCAA enforcement investigations involving high-profile coaches and student-athletes. Further, new NCAA legislation will add to the already complex set of rules that must be maintained by an institution's compliance staff and general counsel's office. The workshop will assist compliance officers, general counsel and higher-education professionals with identifying issues, as well as developing solutions to minimize challenges resulting from rules-compliance "hot topics", infractions decisions and new legislation. Most importantly, workshop participants will review the results of a specially-commissioned survey, as well as infractions decisions, new legislation, media reports and other resources to explore the following issues:
1. What rules-compliance strategies can be developed using an objective analysis of recent enforcement cases and current investigations of alleged NCAA rules-violations?
2. What "hot topics" (and strategies to each) were identified by university administrators in the national survey?
3. What measures can schools use to demonstrate compliance with new NCAA legislation (including the new 9-hour rule for FBS and FCS football)?
4. What procedures should universities use to address rules-compliance issues involving high-profile student-athletes, head coaches, local merchants and sports agents?
Course Objectives and Benefits: The workshop will enable university administrators (including general counsel) to:
• Analyze measures to ensure compliance with new NCAA legislation.
• Assess the future rules-compliance implications of recent and ongoing high-profile enforcement investigations on colleges and universities.
• Develop strategies to ensure compliance with the latest NCAA infractions decisions.
